Default having been made in the terms, conditions, and payments provided in a certain Deed of Trust dated March 29, 2002, executed by Alvin Butts, wife Janice Butts waiving her marital interest and is not obligated for repayment or for the indebtedness, to Fearnley & Califf as Trustee, recorded April 16, 2002, of record at Instrument No. 02065871 in the Register’s Office for Shelby County, Tennessee, conveying certain real property therein described, and Edward D. Russell of The SR Law Group, having been appointed as Substitute Trustee of record at Instrument No. 26042422 in the Register's Office for Shelby County, Tennessee;
WHEREAS, the said Deed of Trust was last assigned to U.S. BANK TRUST NATIONAL ASSOCIATION, AS TRUSTEE FOR PAD SERIES TRUST (“Holder”), by SN Servicing Corporation, its attorney in fact, the entire indebtedness having been declared due and payable to Holder, Holder has requested foreclosure proceedings to be instituted; and as provided in said Deed of Trust, Edward D. Russell of The SR Law Group, will by virtue of the power and authority vested as Substitute Trustee, on Wednesday, July 1, 2026 at 10:00 a.m., at the Southwest Corner of the Shelby County Courthouse, 140 Adams Avenue Memphis, Tennessee, having been postponed from the initial July 16, 2025 sale date, sell to the highest bidder for cash, free from the equity of redemption, homestead, and dower, and all other exemptions which are expressly waived, and subject to any unpaid taxes, if any, the following land situated in Shelby County, Tennessee, to wit:
Lot 18, Section “A”, Hickory Hills Subdivision, as shown on plat of record in Plat Book 22, page 47, in the Register’s Office of Shelby County, Tennessee, to which plat reference is hereby made for a more particular description of said property.
Janic Butts wife of Alvin Butts joins in this Deed of Trust for the sole purpose of waiving all marital interest in said property and is in no way obligated for purpose of repayment of said indebtedness.
This being the same property conveyed to Alvin Butts, unmarried, by deed dated March 29, 2002, recorded April 16, 2002 in Instrument No. 02065871 in the Register’s Office of Shelby County, Tennessee.
