WHEREAS, Good Neighbor Apartments, LLC, by Deed of Trust (the “Deed of Trust”), dated October 28, 2021, and recorded on October 29, 2021, in Record Book 864 at Page 171, Instrument # 230095 in the Register of Deeds Office of Marshall County, Tennessee; and, conveyed to Rusty Thompson, Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note (the “Note”) described in the Deed of Trust, which Note was payable to, Listerhill Credit Union, and
WHEREAS, McPhail Sanchez, LLC has been duly appointed Substitute Trustee by the owner and holder of the Note by instrument recorded in Record Book 917 at Page 801, Instrument # 263082 Marshall County, Tennessee;
WHEREAS, default has been made in the payment of the Note; and
WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust.

Being a portion of the same property conveyed to Peoples and Union Bank, a Tennessee Banking Corporation by Deed from Martha Murray, Ida Murray and Lillie Murray of record in Book I-4, Page 208 Register's Office for Marshall County, Tennessee, dated November 20, 1947 and recorded on November 22, 1947. (Value or consideration as shown in aforementioned deed $65,000.00.) Being a portion of the same property conveyed to F & M West, Inc., a Tennessee Corporation by Warranty Deed from First Farmers and Merchants Bank of record in Book 716, Page 717 Register's Office for Marshall County , Tennessee, dated July 31, 2017 and recorded on July 31, 2017.
Being the same property conveyed to Good Neighbor Apartments, LLC, a Tennessee limited liability company by Special Warranty Deed from F & M West, Inc. of record in Book 861, Page 573, Register's Office for Marshall County, Tennessee, dated August 26, 2021 and recorded on August 27, 2021. Being also known as 111 West Commerce St Lewisburg, Tennessee 37091.
The property is located in Marshall County at 111 W Commerce Street, Lewisburg, Tennessee 37091.
The instrument constituting the source of the Borrower's interest in the foregoing described property was recorded at Book 861, Page 573 under Instrument No., in the Register's Office of County, Tennessee.
Together with all rights, easements, appurtenances, royalties, mineral rights, oil and gas rights, all water and riparian rights, wells, ditches and water stock, crops, timber including timber to be cut now or at any time in the future, all diversion payments or third party payments made to crop producers and all existing and future improvements, structures, fixtures, and replacements that may now, or at any time in the future, be part of the real estate described (all referred to as Property). This Security Instrument will remain in effect until the Secured Debts and all underlying agreements have been terminated in writing by Lender.
The street address of the above-described property is believed to be 111 W Commerce St., Lewisburg, TN 37091 but if such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.

If the U.S. Department of the Treasury/Internal Revenue Service, the State of Tennessee Department of Revenue, or the State of Tennessee Department of Labor and Workforce Development are listed as interested parties in the advertisement, then the notice of this foreclosure is being given to them, and the sale will be subject to the applicable governmental entities right to redeem the property, all as required by 26 U.S.C. 7425 and T.C.A. 67-1-1433.
