NOTICE OF SUBSTITUTE TRUSTEE’S SALE
Default having been made in the terms, conditions, and payments provided for in that certain Deed of Trust dated January 11, 2021, of record in Book 1598, Page 242, Register’s Office for Cumberland County, Tennessee, from Robert Lee Daugherty, III and Amy L. Lewis (“Borrower”) to Susan Hyder, Trustee, securing the indebtedness therein described, which indebtedness is now due and unpaid, and has been declared in default by the lawful owner and holder thereof; and
The undersigned, Darren W. Kennedy, Successor Trustee, having been appointed Successor Trustee on December 15, 2025, of record in Book 1738, Page 2592, said Register’s Office, to serve in the place and stead of Susan Hyder, Trustee;
NOW, THEREFORE, I, Darren W. Kennedy, Successor Trustee, pursuant to said Deed of Trust, having been requested by the Trustees of the Midge Kilby Trust, dated 3/29/2010, the owner and holder of said indebtedness, so to do, and by virtue of the authority and power vested in me by said Deed of Trust will, on April 1, 2026, at 11:00 a.m., at the Cumberland County Courthouse, 2 N. Main Street, in Crossville, Cumberland County, Tennessee:

FIRST TRACT
BEING a part of the Two hundred acre grant in the name of Daniel Conley, said land consist mostly of pine fields that was formerly in cultivation and same being on a stake on the west side of the road leading from the M. L. Taylor house to the Anderson place; thence South 42 degrees East 41 poles to a stake corner, Northeast of Old Road; thence South 45 West 4 poles to a turn or offset of 3 poles running North 42 West; thence South 45 West 22 poles with the old road to a stake; thence North 40 West 68 poles to a stake in hillside; thence East 35 poles to the BEGINNING and containing ten (10) acres, more or less.
SECOND TRACT
BEGINNING at a rock in the center of an old road North 57 degrees East 12 poles from a Chestnut Oak, the South corner of Taylor’s Chapel Church land; thence South 65 East 55 poles to a sourwood in the edge of an old field; thence South 57 poles to a rock pile, in the South boundary line of Grant 1144 to Daniel Conley; thence East with said Grant line 94 poles to a Walnut stump near a branch; thence North 80 poles to a black gum in the line of Fred Hamby’s fence and the Southeast corner of a 50 acre Grant 4075 to John McKinney; thence West with Hamby’s fence to the center of a lane to a stone; thence about 60 poles with center of land to Board Tree Branch; thence down said branch about 60 poles with center of lane to Board Tree Branch; thence down said branch about 60 poles to a rock with white oak pointers; thence West with McKinney line and passing Joe Louis corner 146 poles to a white oak in the West boundary line of Conley 200 acre tract; thence South with said line 70 poles to a white oak on North side of Clifty Road; thence with said road South 72 degrees East 26 poles of M.L. Taylor’s Road; thence North 40 East with said Taylor Road 36 poles to a stone in the road; thence South 10 East 33 poles to the BEGINNING, containing 92 acres, more or less.
Being the same property conveyed by Warranty Deed of record in Book 1598, Page 238, in the Register’s Office of Cumberland County, Tennessee.

This sale is subject to all matters shown on any recorded plat; any and all liens, easements or setback lines, restrictive covenants, any matter that an accurate survey of the premises might disclose, encumbrances, property taxes, rights of redemption of taxing entities, and other matters which are prior in right to the lien of the aforesaid Deed of Trust. Trustee will only convey any interest he may have in the property at the time of the sale. The right is reserved to adjourn the day of the sale to another day, time and place for the sale set forth above, without further publication, upon announcement. Property is being sold “as is, where is.” If you purchase a property at the foreclosure sale, the entire purchase price is due and payable at the conclusion of the auction in the form of a certified/bank check made payable to Darren W. Kennedy. No personal checks will be accepted. To this end, you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded to the successful purchaser at the time the foreclosure deed is delivered. This sale may be rescinded by the Trustee at any time. This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the purchase price. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. THIS OFFICE IS ATTEMPTING TO COLLECT A DEBT.
