WHEREAS, Riverfront Capital, LLC, a Tennessee limited liability company (Rip Bains), by Deed of Trust (the “Deed of Trust”), dated September 18, 2024, and recorded on October 2, 2024, in Instrument No. 24085093 in the Register of Deeds Office of Shelby County, Tennessee; and, conveyed to Cypress Ascendant Services, Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note (the “Note”) described in the Deed of Trust, which Note was payable to, BPL Mortgage, LLC, a Delaware limited liability company, which the aforementioned Deed of Trust was subsequently assigned to Metropolitan Life Insurance Company dated September 22, 2025 and recorded in Instrument No. 25082897; and
WHEREAS, McPhail Sanchez, LLC has been duly appointed Substitute Trustee by the owner and holder of the Note by instrument recorded in Instrument No. 25096055, Shelby County, Tennessee;
WHEREAS, default has been made in the payment of the Note; and
WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust.
NOW, THEREFORE, notice is hereby given that an agent of McPhail Sanchez, LLC, Substitute Trustee, pursuant to the power, duty, and authority vested in and conferred by the Deed of Trust, on January 8, 2026 at 12:00 PM at the Shelby County Courthouse located at 140 Adams Avenue, Memphis, TN will be sold to the highest call bidder for cash free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Shelby County, Tennessee, described as follows:
Part of the Wiley Stainback 8.09 Acre of the Tom Berry 27 Acres in the First Civil District of Shelby County, Tennessee; Beginning at the most Westerly Northwest Corner of the Wiley Stainback 8.09, said point being the Southwest Corner of the William Jones One Acre; thence South 16 degrees and 15 minutes East with the West Line of the Wiley Stainback 8.09 Acres 210 feet; thence North 84 degrees East 215 feet; thence North 16 degrees and 15 minutes West 210 feet to the Southwest Corner of the William Jones 1 Acre; thence South 84 degrees West with the South Line of the William Jones One Acre 215 feet to the Point of Beginning.
Being the same property conveyed to Moncel Wooten by Special Warranty Deed from U.S. Bank National Association, as trustee, for Conseco Finance Home Equity Loan Trust 2002-C of record as Instrument No. 21027507 in the Register's Office for Shelby County, Tennessee, dated January 21, 2021 and recorded on March 10, 2021. Being also known as 3762 Berry Lane, Memphis, TN 38128, situate in the County of Shelby, State of Tennessee.
The street address of the above-described property is believed to be 3762 Berry Ln, Memphis, TN 38128 but if such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.
