NOTICE OF FORECLOSURE SALE
WHEREAS, a default having occurred in the payment of the debts and obligations secured by certain Open End Deed of Trust recorded in Book 8925, Page 350 in the Register’s Office of Hamilton County, Tennessee (the “Deed of Trust”), wherein Robert J. Georgitso and Diann Georgitso conveyed to Chris Varnell, as Trustee, the real property described below (the “Real Property”) to secure payment of a certain TLC Home Equity Options Agreement, as amended by that certain Fixed Rate Option Agreement (collectively the “Note”) owed to Synovus Bank, formerly known as Columbus Bank and Trust Company, as successor in interest through name change and by merger with Cohutta Banking Company as described in said Deed of Trust, and all extensions, renewals, modifications or substitutions thereto, which Deed of Trust and Note have been assigned to Robert Barnett, as Trustee of the RH 401(k) Plan, pursuant to an Assignment of Note, Deed of Trust, and other Loan Documents dated December 16, 2025 and recorded in the Register’s Office of Hamilton County, Tennessee at Book 14180, Page 825; NOTICE is hereby given that the entire indebtedness has been accelerated and declared immediately due and payable and that Robert Barnett, as Trustee of the RH 401(k) Plan, assignee of Synovus Bank, and Patrick, Beard, Schulman & Jacoway, P.C., Successor Trustee pursuant to the Substitution of Trustee and Appointment of Successor Trustee recorded in the Register’s Office of Hamilton County, Tennessee at Book 14205, Page 186, and any successor trustee who may succeed them, pursuant to the power, duty and authority vested in and imposed upon the same in said Deed of Trust, will on April 7, 2026 at 10:00 o’clock a.m. at the West door of the Hamilton County Courthouse in Chattanooga, Tennessee, offer for sale to the highest and best bidder for cash, and free from any equity of redemption, statutory right of redemption, homestead, dower, curtesy and all other exemptions which are expressly waived in the Deed of Trust, the Real Property being more particularly described as follows:

Said foreclosure sale will be subject to: (1) any and all unpaid ad valorem and real property taxes (plus penalty and interest, if any) that may be a lien upon the Real Property, (2) any and all liens, defects, encumbrances, adverse claims and all other matters which take priority over the Deed of Trust upon which this foreclosure sale is had, (3) any statutory rights of redemption not otherwise waived in the Deed of Trust, including rights of redemption of any governmental agency, state or federal, which might not have been waived by such governmental agency, (4) all notes, stipulations, restrictions, easements, conditions and regulations as set out on recorded plat (5) any governmental zoning and subdivision ordinances or regulations in effect thereon, (6) the accuracy of the Index Book of the said Register’s Office and any other matters which an accurate survey of the Real Property might disclose, and (7) all other matters which are prior in right to the lien of the Deed of Trust and all matters shown on any applicable plat.
Successor Trustee will make no covenant of seisin or warranty of title, express or implied, and will sell and convey by Trustee’s Deed as Successor Trustee. Further, the transfer shall be “As Is” and without warranty of any kind, express or implied, as to the condition of such property and the improvements located thereon, including merchantability or fitness for particular purpose.
The right is reserved to adjourn the day of sale to another date and time without further publication upon announcement at the time set above and to sell to the second highest bidder in the event the highest bidder does not comply with the terms of the sale.
