WHEREAS, V and R Investments LLC (Raymond Luis Brito and Vanessa M. Romero), by Deed of Trust (the “Deed of Trust”), dated October 3, 2023, and recorded on October 13, 2023, in Instrument No. 23087939 in the Register of Deeds Office of Shelby County, Tennessee; and, conveyed to Haven Title LLC, Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note (the “Note”) described in the Deed of Trust, which Note was payable to, BPL Mortgage Trust, LLC, which the aforementioned Deed of Trust was subsequently assigned to Pacific Asset Holding, LLC dated June 26, 2024 and recorded in Instrument No. 24054703; and
WHEREAS, McPhail Sanchez, LLC has been duly appointed Substitute Trustee by the owner and holder of the Note by instrument recorded in Instrument No. 25105945, Shelby County, Tennessee;
WHEREAS, default has been made in the payment of the Note; and
WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust.
NOW, THEREFORE, notice is hereby given that an agent of McPhail Sanchez, LLC, Substitute Trustee, pursuant to the power, duty, and authority vested in and conferred by the Deed of Trust, on February 12, 2026 at 12:00 PM at the Shelby County Courthouse located at 140 Adams Avenue, Memphis, TN will be sold to the highest call bidder for cash free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Shelby County, Tennessee, described as follows:
Situated and being located in Shelby County, Tennessee, as Lot 47, Highland View Subdivision, as shown on Plat of record in Plat Book 17. Page 35, in the Register's Office of Shelby County, Tennessee, to which plat reference is hereby made for a more particular description of said property.
Being the same property conveyed to Patricia Ann Walker by Warranty Deed from Thelma S. Shearer, an unmarried person of record as Instrument No. JZ6181 in the Register's Office for Shelby County, Tennessee, dated January 28, 2000 and recorded in February 2, 2000.
Being the same property conveyed to Innovative Real Estate Investments, LLC by Warranty Deed from Patricia Ann Walker of record as Instrument No. 22061564 in the Register's Office for Shelby County, Tennessee, dated May 19, 2022 and recorded June 1, 2022.
Being the same property conveyed to V and R Investments LLC, a New Mexico Limited Liability Company by Warranty Deed from Innovate Real Estate Investments, LLC, a New Mexico Limited Liability Company of record as Instrument No. 22087980 in the Register's Office for Shelby County, Tennessee, dated July 29, 2022 and recorded on August 5, 2022.
