WHEREAS, ML Housing, LLC (Matthew John Bennett), by Deed of Trust (the “Deed of Trust”), dated November 21, 2023, and recorded on December 12, 2023, in Instrument No. 23105299 in the Register of Deeds Office of Shelby County, Tennessee; and, conveyed to Saddle Creek Title, LLC, Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note (the “Note”) described in the Deed of Trust, which Note was payable to, BPL Mortgage Trust, LLC, which the aforementioned Deed of Trust was subsequently assigned to Pacific Asset Holding, LLC dated August 15, 2024 and recorded in Instrument No. 24070582; and
WHEREAS, McPhail Sanchez, LLC has been duly appointed Substitute Trustee by the owner and holder of the Note by instrument recorded in Instrument No. 25040752, Shelby County, Tennessee;
WHEREAS, default has been made in the payment of the Note; and
WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust.
NOW, THEREFORE, notice is hereby given that an agent of McPhail Sanchez, LLC, Substitute Trustee, pursuant to the power, duty, and authority vested in and conferred by the Deed of Trust, on December 17 at 12:00 PM at the Shelby County Courthouse located at 140 Adams Avenue, Memphis, TN. will be sold to the highest call bidder for cash free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Shelby County, Tennessee, described as follows:
Lot 107, Westwood Manor Subdivision, Section A, as shown on plat of record in Plat Book 23, Page 36, in the Register's Office of Shelby County, Tennessee, to which plat reference is hereby made and more particularly described as follows:
The south part of Lot 107, being Lot 107, LESS AND EXCEPT the north 13.75 feet of Lot 107, conveyed in Warranty Deed of Record at Instrument No. U6 7677 and which Deed described Lot 106 and the North 13.75 feet of Lot 107, Section A, Westwood Manor Subdivision, Plat Book 23, Page 36 as follows:
Beginning at a chisel mark in the east line of Overton Crossing Street 178.75 northwardly from the point of intersection of the tangents to a curve having a radius of 30 feet located at the northeast corner of Overton Crossing Street and Pamela Avenue, said point being 13.75 feet southwardly from the line dividing Lots 106 and 107; thence northwardly with the east line of Overton Crossing Street 96.25 feet to the south line of Lot 105; thence westwardly with the south line of Lot 105, 159.75 feet to the west line of Lot 7; thence southwardly with the west line of Lots 7 and 6, 96.25 feet; thence westwardly 159.85 feet to the point of beginning.
Being the same property conveyed to Laksh Nandrajog by Warranty Deed recorded on 11/26/2019 at Instrument No. 19122957, in the Register's Office of Shelby County, Tennessee.
