Default having been made in the terms, conditions, and payments provided in a certain Deed of Trust dated August 15, 2006, executed by Michael R. Thompson Individual, to Larry A. Weissman as Trustee, the Deed of Trust being recorded in Book GI 8050, Page 964 in the Register’s Office for Hamilton County, Tennessee, conveying certain real property therein described, and Edward D. Russell of The SR Law Group, having been appointed as Substitute Trustee of record in Book GI 14081, Page 58 in the Register's Office for Hamilton County, Tennessee;
WHEREAS, the said Deed of Trust was last assigned to U.S. Bank Trust National Association, as Trustee of Dwelling Series IV Trust (“Holder”), by SN Servicing Corporation, its attorney in fact, the entire indebtedness having been declared due and payable to Holder, Holder has requested foreclosure proceedings to be instituted; and as provided in said Deed of Trust, Edward D. Russell of The SR Law Group, will by virtue of the power and authority vested as Substitute Trustee, on Thursday, December 4, 2025 at 10:00 a.m. on the Courthouse steps at the Hamilton County Courthouse, 625 Georgia Ave, Chattanooga, Tennessee, sell to the highest bidder for cash, free from the equity of redemption, homestead, and dower, and all other exemptions which are expressly waived, and subject to any unpaid taxes, if any, that certain tract or parcel of land in Hamilton County, (erroneously referred to as Sumner County in deed of acquisition) State of Tennessee, described as follows, to wit:
Being a part of Lot Three (3), Block Forty-Seven, Orchard Knob, as shown by Plat Book 1, page 41, in the Register’s Office of Hamilton County, Tennessee. According to said plat said part of Lot fronts 50 feet on the South line of Ivy Street, and extends back Southwardly, between parallel lines, 124 feet to a fence line.
Being the same property conveyed to Michael R. Thompson by Special Warranty Deed from Wells Fargo Bank, NA as Trustee under Pooling and Servicing Agreement dated as of April 1, 2004 Merrill Lynch Mortgage Investors Trust Mortgage Loan Asset-Backed certificates, series 2004-WMC3, Book 8050, Page 960, dated August 15, 2006, recorded August 17, 2006, in the Register’s Office of Hamilton County, Tennessee.
